INTRODUCTION

Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

About KrugerGuide

KrugerGuide is a mobile application designed to enhance visitor experiences at Kruger National Park. 

Please be aware that the Service Provider does not assume responsibility for certain aspects. Some functions of the Application require an active internet connection, which can be Wi-Fi or provided by your mobile network provider. The Service Provider cannot be held responsible if the Application does not function at full capacity due to lack of access to Wi-Fi or if you have exhausted your data allowance.

If you are using the application outside of a Wi-Fi area, please be aware that your mobile network provider's agreement terms still apply. Consequently, you may incur charges from your mobile provider for data usage during the connection to the application, or other third-party charges. By using the application, you accept responsibility for any such charges, including roaming data charges if you use the application outside of your home territory (i.e., region or country) without disabling data roaming. If you are not the bill payer for the device on which you are using the application, they assume that you have obtained permission from the bill payer.

Similarly, the Service Provider cannot always assume responsibility for your usage of the application. For instance, it is your responsibility to ensure that your device remains charged. If your device runs out of battery and you are unable to access the Service, the Service Provider cannot be held responsible.

  • Wildlife Database - Species information including birds, mammal and reptiles for featured species
  • Multi-language Support - Species names and search available in multiple languages for international visitors
  • Directions with GPS location - Directions for pre-populated routes provided with the app
  • Community Platform - wildlife sighting sharing capabilities
  • Trip reports - Log sightings with locations and notes
  • Social Integration - Account creation and login via Google and Apple sign-in

Data Collection Statement: We adhere to data minimization principles, collecting only information essential for:

  • Providing requested Services
  • Protecting system security and integrity
  • Complying with legal obligations
  • Improving user experience with your consent

The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advise against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone's security features, and may result in the Application not functioning correctly or at all.

Please note that the Application utilizes third-party services that have their own Terms and Conditions. Below are the links to the Terms and Conditions of the third-party service providers used by the Application:

YOUR AGREEMENT WITH US

Formation of Contract

By accessing, downloading, installing, or using KrugerGuide in any manner, you acknowledge and agree that:

  1. You have read, understood, and agree to be bound by these Terms and Conditions in their entirety
  2. You have read and accept our Privacy Policy (incorporated herein by reference)
  3. You are entering into a legally binding contract with Kruger Guide (Pty) Ltd
  4. These terms constitute the entire agreement between you and us regarding the Services
  5. Any prior agreements, understandings, or representations are superseded by these terms

This agreement is formed when you:

  • Click "Accept" or "Agree" during registration
  • Download or install the application
  • Access or use any Service features
  • Create an account or sign in
  • Continue using Services after being presented with these terms

Capacity to Enter Agreement

You represent and warrant that:

  • You are at least 18 years of age or the age of majority in your jurisdiction
  • You have the legal capacity to enter into binding contracts
  • You are not barred from using the Services under any applicable laws
  • If accepting for an entity, you have actual authority to bind that entity
  • Your use will not violate any applicable laws or regulations

Minors: If you are under 18, you may only use our Services with parental or guardian consent and supervision. Parents/guardians are fully responsible for minor usage.

Rejection of Terms

  • Uninstall the application from all devices
  • Contact us to request account deletion if applicable

Your continued use constitutes ongoing acceptance of these terms and any updates.

We reserve the right to modify these terms at any time by:

  • Providing notice through the app interface when material changes occur
  • Sending email notification for significant changes (at our discretion)

Your responsibilities:

1. USING OUR SERVICES

Prohibited Regulated Uses

You may not use our Services for:

Violation of this section constitutes material breach and grounds for immediate termination.

  • Non-commercial wildlife photography and documentation
  • Personal wildlife sighting records and journals

Fair Use Limitations

To ensure service quality for all users we monitor usage based on a fair usage limits for interactions with our platforms. These limits are imposed on but limited to:

  • API calls
  • Data download
  • Sighting reports
  • Photo uploads
  • Concurrent sessions

Exceeding any of our imposed limits may result in temporary or permanent suspension of your account and device.

2. YOUR ACCOUNT

Account Creation and Registration

Registration Requirements

To create an account, you must provide:

  • Valid email address that you own and can access
  • Authentication method (password or social login credentials)

You are solely responsible for keeping your password confidential

Account Creation Methods

You may register through:

  1. Direct registration - Email and password combination
  2. Google Sign-In - Using your Google account credentials
  3. Apple Sign-In - Using your Apple ID credentials
  4. Other methods - As we may implement in the future

Identity Verification

We reserve the right to:

Account Security and Responsibility

Your Security Obligations

You are solely responsible for:

  • All activities occurring under your account
  • Preventing unauthorized access to your account
  • Immediately notifying us of any security breach
  • Losses resulting from unauthorized account use

Security Best Practices

We strongly recommend:

  • Using a unique, strong password (minimum 8 characters with mixed case, numbers, and symbols)
  • Use social sign-ons like Google and Apple instead of email and password
  • Regularly updating your password
  • Not sharing accounts between multiple users
  • Not using public WiFi for sensitive account actions

Unauthorized Access

If you suspect unauthorized access:

  1. Change your password immediately
  2. Contact us at hello@kruger.guide within 24 hours
  3. Review recent account activity

We are not liable for losses from unauthorized access resulting from your failure to maintain account security.

Username and Profile Standards

Username Requirements

Usernames must:

  • Contain only letters, numbers, underscores, or hyphens
  • Be unique within our system
  • Not impersonate others or entities
  • Not contain profanity or offensive terms
  • Not infringe on trademarks or intellectual property

Prohibited Usernames

We will reject or remove usernames that:

  • Impersonate our company or staff

Profile Content

Your profile information must:

  • Respect others' privacy
  • Not include contact information meant to bypass our systems

Account Suspension and Termination

Grounds for Suspension

We may suspend your account for:

  • Suspected fraudulent activity
  • Violation of these terms
  • Excessive failed login attempts
  • Unusual activity patterns
  • Non-payment of fees
  • Legal compliance requirements

Investigation Process

During suspension:

  • Access to Services will be restricted

  • Resolution typically occurs within 7-14 business days

Account Termination

Permanent termination may result from:

Effects of termination:

  • Immediate loss of access to all Services
  • Deletion of account data (subject to legal retention requirements)
  • Forfeiture of any prepaid subscription periods
  • Prohibition on creating new accounts
  • Potential legal action for outstanding obligations

3. PAYMENTS AND SUBSCRIPTIONS

  • Google Play Store - For Android devices with compatible screen sizes

We do not directly handle payment information. Your financial data is managed entirely by these platforms according to their respective terms of service and privacy policies.

By making a purchase, you represent and warrant that:

  • You are authorized to use the selected payment method
  • All payment information provided is accurate and complete
  • You have sufficient funds or credit available
  • You will promptly update payment information as needed
  • You accept the payment processor's terms and conditions

Subscription Terms and Conditions

Subscription Types

Premium Annual/Pro Subscription:

  • Duration: 12 months from purchase date
  • Auto-renewal: Enabled by default
  • Renewal notice: Handled by your app store
  • Features: Full access to all premium features

Free Trial (When Offered):

  • Eligibility: New users only, one per account
  • Duration: As specified in offer (typically 3-7 days)
  • Conversion: Automatically converts to paid subscription
  • Cancellation: Must cancel before trial ends to avoid charges
  • Features: Full premium access during trial period

Free Version(While offered):

  • Duration: Perpetual
  • Features: Limited functionality including
  • Upgrade: Can upgrade to premium/pro anytime

Pro Access - Single payment(While offered):

  • Duration: Perpetual
  • Features you get access to: All Pro features as available at time of purchase. Additional features may be added in future that require a new purchase.
  • Feature deprecation: Features may be deprecated for all users in future and this will apply to single-payment customers as well.

Auto-Renewal Terms

By purchasing a subscription, you explicitly consent to:

  • Automatic renewal at the end of each subscription period
  • Charges to your payment method without further authorization
  • Renewal at the then-current subscription price
  • Responsibility for managing your subscription settings
  • Understanding that renewal occurs 24 hours before period ends

Billing Practices

  • Charge timing: Within 24 hours before subscription expires
  • Failed payments: Access suspended until payment succeeds
  • Multiple attempts: Payment processors may retry failed charges
  • Grace period: Varies by platform
  • Proration: No proration for partial subscription periods

Pricing and Changes

Price Changes

We reserve the right to modify prices by:

Cancellation and Refund Policy

  • Access continues until end of current paid period
  • No partial refunds for unused time
  • Cannot cancel through our app directly

All refunds are to be requested through the app store of purchase.

4. INTELLECTUAL PROPERTY RIGHTS

  • All visual content including photos, videos, and graphics

  • Algorithms, methods, and technical processes
  • Trademarks, service marks, logos, and trade names
  • Trade secrets and confidential information

Legal Protection: Our intellectual property is protected under:

No Transfer of Rights

Violations may result in immediate termination and legal action.

In terms of the Service Provider's responsibility for your use of the application, it is important to note that while they strive to ensure that it is updated and accurate at all times, they do rely on third parties to provide information to them so that they can make it available to you. The Service Provider accepts no liability for any loss, direct or indirect, that you experience as a result of relying entirely on this functionality of the application.

Modifications

We may:

  • Add, change, or remove features
  • Implement updates and improvements
  • Temporarily suspend for maintenance
  • Permanently discontinue Services

No liability for any service interruptions or changes. The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.

The Service Provider may wish to update the application at some point. The application is currently available as per the requirements for the operating system (and for any additional systems they decide to extend the availability of the application to) may change, and you will need to download the updates if you want to continue using the application. The Service Provider does not guarantee that it will always update the application so that it is relevant to you and/or compatible with the particular operating system version installed on your device. However, you agree to always accept updates to the application when offered to you. The Service Provider may also wish to cease providing the application and may terminate its use at any time without providing termination notice to you. Unless they inform you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must cease using the application, and (if necessary) delete it from your device.

8. DISCLAIMERS AND LIABILITY

We expressly disclaim all warranties, including:

  • Merchantability and fitness for purpose

  • Uninterrupted or error-free operation

  • Freedom from viruses or harmful code

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are not liable for:

  • Indirect, incidental, or consequential damages
  • Lost profits, data, or opportunities
  • Service interruptions or data loss
  • Third-party actions or content
  • Damages exceeding amounts paid to us in the past 6 months

Your Indemnification

You agree to defend and hold harmless Kruger Guide (Pty) Ltd from claims arising from:

  • Your use of the Services
  • Your content or contributions
  • Violation of these terms
  • Infringement of others' rights
  • Illegal or harmful actions

9. DISPUTE RESOLUTION

These terms are governed by the laws of South Africa, without regard to conflict of law principles.
